Article 1. Applicability
1.1 These Terms and Conditions apply to all offers, orders and agreements of KARMAN.
1.2 The placing of an order or accepting an offer means that you accept the applicability of these General Terms and Conditions.
1.3 The provisions can be done in writing in these conditions, in which case the remaining provisions shall remain in force.
1.4 All rights and claims contained in these Terms and Conditions shall be stipulated in any further agreements on behalf of Karman, are also stipulated for by KARMAN intermediaries and other third parties.

Article 2. Agreements

2.1 All Karman offers are non-committal and Karman reserves the right to change prices.
2.2 An agreement is only after acceptance of your order by Karman. Karman is entitled to refuse orders or attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, Karman will inform you within three working days of receiving the order.

Article 3. Prices and payments
3.1. The mentioned prices for the offered products and services are in Euro, including VAT and including handling and shipping, taxes or other charges unless otherwise stated or agreed in writing.
3.2 For transport in the Netherlands, we do not charge fees. For customers from other countries than the Netherlands, the contribution to the shipping costs depending on the country and the amount of the order.
3.3 After an order, you receive a confirmation e-mail with the total cost, including shipping, stated. Payment can be made by iDEAL or transfer. There will be no additional charge for the online payment.

Article 4. Delivery
4.1 After receiving the order and payment we will send the order within two working days with Post NL to the delivery address on the order. If there is any delay, you will be notified by email.
4.2 Karman is not responsible for any post related delays.
4.3 Exceeding the agreed delivery times, the customer is not entitled to compensation, termination of the contract or non-fulfillment of any obligation imposed on him by this or any other related agreement.
4.4 The product must be delivered no later than 21 days after receiving the order and payment, to the customer. If this is not done, the customer can undo the order. This does not apply if the parties have agreed a different delivery period.
4.5 We do our best to keep the website up to date, but it can occur that a product is no longer available. In this case, we will contact you promptly by email.

Article 5. Return
5.1 We make every effort to deliver a perfect product. If the ordered item does not meet your expectations, you can return your order within 14 calendar days of receiving the order.
Receiving the order is equal to the second delivery attempt. If within this period no written complaints have been received, Karman is considered to have been fully complied with its obligations.
5.2 We will solve any problem as soon as possible. If the solution does not meet your expectations then you can cancel the order without any additional costs. The amount already paid will be refunded to you within four business days after the order is returned or cancelled.
This warranty is void if a. The products is worn and / or washed, b. you have tried to repair a defect, c. the user instructions are not followed d. the return policy rules are not followed.
5.3 If, for whatever reason you do not wish to purchase the product anymore, you have the right to return the product within 14 calendar days after delivery, back to Karman. Returns are only accepted if the packaging of the product is undamaged, the product is not worn and undamaged and is equipped with all labels, including Karman dustbag and original Karman packaging. The transmissions costs  and risk of return are for your own account. Except when the order has defects revealed. Returns that are not returned in its entirety, are not accepted and are returned to the sender, with the result that the purchase amount will not be refunded.
When receiving the returned order correctly and in good conditions, the order amount will be refunded to you within four business days after the order is returned.
5.4 As receiver you have the obligation to examine the delivered products if they meet the agreement. If this is not the case, you should contact Karman as soon as possible, at least within three working days after the delivery, or after reasonably observation was possible. You should contact Karman with a clear description of the problem at service@karmanbag.com and leave your information so we can solve the problem as soon as possible.
5.5 If it is demonstrated that the products do not meet the agreement, KARMAN choose the products to be returned and replaced by new products if in stock.

Article 6. Liability
6.1 Any liability of Karman, the staff and the products of Karman for all damages of any kind, direct or indirect, including loss, consequential loss, damage to movable or immovable property or persons, are explicitly excluded.
6.2 Karman is not liable for damage caused by third parties by implementing the agreement.
6.3 Karman accepts no liability for any damage arising from the use of the products KARMAN.
6.4 Any liability of Karman towards buyer is in any case limited to a maximum of the invoice amount the buyer agreed to.
6.5 In misunderstanding, delays or transmission of orders and messages resulting from the use of Internet or any other means of communication between customer and Karman or between Karman and others, as it relates to the relationship between customer and Karman, Karman is not liable, unless and to the extent there might be intentional or gross negligence of Karman.

Article 7. Copyright
7.1 You should fully and unconditionally respect all intellectual and industrial property rights that belong to Karman and to Karman products.
7.2 Karman does not guarantee that the delivered products do not infringe any (unwritten) intellectual and / or industrial property of third parties.
7.3 All images or parts of images that are available on this website, without the express permission of the author is multiplying, print or complete sections of text documents downloaded files / Photography strictly prohibited on the basis of copyright

Article 8. Warranty
8.1 Karman guarantees that the delivered products meet the usual requirements and standards that can be made and are free of any defect whatsoever.
8.2 If the delivered goods do not conform to this warranty, Karman shall, within a reasonable time after receipt thereof, or, if return is not reasonably possible, written notification of the defect by the buyer, at the choice of Karman, replace or repair.
8.3 This guarantee does not apply if the defect has arisen as a result of improper or inappropriate use or when, without written permission of Karman, buyer or third parties have made changes or attempted to alter the product or have used for purposes for which this product was not intended.
8.4 Besides these warranty provisions the legal warranty conditions apply.

Article 9. Ascendancy
9.1 Ascendancy means any shortcoming which cannot be attributed to Karman, because it is not due to her fault and not under law, legal act or generally accepted conception.
9.2 In case of Ascendancy, Karman has the right, at its option, to suspend the execution of you order or to terminate the agreement without judicial intervention. Karman is required to communicate this in writing to the buyer and Karman is not responsible for any compensation.

Unless this would be unacceptable in the circumstances to standards of reasonableness and fairness.

Article 10. Privacy
10.1 Any personal data will only be used for processing the order and will never be made available to third parties, accept to process the order for delivery.

Article 11. Miscellaneous
11.1 If you give your address to Karman during your order, then Karman is entitled to send all orders to that address, unless you give Karman a writing notice by email that indicates a different address to which you want you order to be sent to.
11.2 When by Karman for any length of time does not deviate from these Conditions, will not prejudice their right to demand immediate and strict compliance with these Terms and Conditions. You can never assert any right by virtue of the fact that Karman applies these Conditions flexibly.
11.3 If one or more provisions of these terms or any other agreement with Karman are in conflict with any applicable provision, the relevant provision will lapse and will be replaced by adopting a by Karman new comparable lawful condition.
11.4 KARMAN is competent to use third parties for the execution of your order.

Article 12 Law and jurisdiction
12.1 All rights, obligations, offers, orders and agreements to which these General Conditions apply, including these Terms, are only applicable with Dutch law.
12.2 All disputes between parties will be submitted exclusively to the competent court in the Netherlands.
